Passenger Injured in Head On Collision - $4.7 MILLION

A $4.7 million dollar settlement was achieved on behalf of a passenger injured in a head-on collision. 

Driver Injury - $1 MILLION

A fifty-year old married woman driver was struck by a vehicle making a U-turn and sustained serious injuries. This case was settled for the full insurance policy amount of $1 million. 

Pedestrian Injury - $700,000

In this matter the plaintiff suffered bi-lateral leg fractures after being struck by defendant’s vehicle. The Med Law team was able to achieve a settlement in the amount of $700,000 on behalf of the plaintiff. 

Pedestrian Knockdown - $410,000

In a pedestrian Knockdown case with a question as to who had the light in their favor, the Medlaw team achieved a $410,000.00 settlement on behalf of a young man who sustained a fractured wrist that required surgery. 

Construction Accidents

Timber Falls on Worker’s leg - $2 MILLION

The plaintiff, a middle-aged construction worker, was injured when a load of timbers which was being hoisted fell and injured his leg. He was left with a permanent limp. In this matter the plaintiffs were able to achieve a settlement of $1,400,987.50 and additional monthly payments to the plaintiff for the remainder of his lifetime. The total value of the settlement package, had a value of over $2 million. 

Fall from Scaffold - $550,000

In this matter, the law firm of Bonina & Bonina was able to achieve $550,000 settlement and a waiver of a worker’s compensation lien of $140,000 on behalf of a man who had fallen from a scaffold and injured his back while working at construction site. The defendant argued that damages were limited by the fact that the plaintiff had returned to work in another profession, had never had surgery and had not received on-going medical care.

Fall from Scaffold- $275,000

In this matter the plaintiff an asbestos removal worker, fell from a scaffold at a removal site and sustained a concussion as well as an injury to his rotator cuff. The case was settled for $275,000.

Premises Actions

Fall down stairs - spinal cord injury - $7.8 MILLION

In this matter a young man suffered a spinal cord injury as a result in a fall down a defective stairway. The law firm of Bonina & Bonina was able to achieve a settlement that included $3,800,000.00 ($3.8 million) of immediate payments as well as a lifetime annuity which paid the plaintiff $9,000 per month increasing annually for the balance of his lifetime.

Fall on Stairs - $1.3 MILLION

In this matter a young man fell on wood and other debris while walking down a stairwell and suffered a herniated disc in his back. Bonina & Bonina successfully settled this case in the amount of $350,000 plus over $2,000 per month being paid to the plaintiff for the remainder of his lifetime. This settlement package had a total value of approximately $1.335 million dollars.

Slip on grease - $625,000

A $625,000 settlement was achieved on behalf of a working man in his 40s who slipped on grease and aggravated a pre existing hip and Achilles tendon injury. The grease was leaking from a defective scissor lift which had been improperly repaired days earlier by the maintenance company responsible for keeping it in safe working order.

Trip and fall - $550,000

In this matter the plaintiff tripped as a result of a misleveled elevator and sustained a head injury that resulted in a seizure disorder. The defendants claimed the seizure disorder was pre-existing and not due to any injuries sustained in this accident. This matter was ultimately settled to the sum of $550,000.

Fall down defective stairs - broken hip - $420,000  

In this matter a middle-aged hospital worker fractured his hip falling down a defective stairway. 
The case was settled for $420,000.

Medical Malpractice

Failure to diagnose aneurysm- $1.35 MILLION

Failure to diagnose brain aneurysm in a working mother results in rupture, memory loss and right sided weakness. $1.35 Million Settlement

Fall from ladder causes fractured leg requiring two surgeries and resulting in compartment syndrome - $1.3 MILLION

A worker at a restoration site sustained a broken leg requiring two surgeries and resulting in compartment syndrome after falling from an unsecured and defective ladder. The injury impaired his circulatory and vascular functioning in his leg and prevented him from working. 1.3 Million dollar settlement

Failure to recognize malfunction of defective medical product causes wrongful death - $1 MILLION

Failure to properly monitor a 48 year old mother of three after placement of a defective tracheostomy results in her death. The medlaw team successfully litigated this matter against both the doctors who failed to monitor the patient and the manufacturers of the defective product, obtaining a $1,000,000 settlement on behalf of the family.

Negligently Performed Episiotomy - Colostomy - $900,000

Improper repair of a 4th degree lacerations with sutures that were not strong enough to hold the lacerations together results in recurrent fistulas and the need for colostomy and colostomy reversal surgeries. $900,000.00 settlement

Negligent Highway Design - Head on Collision - $800,000

Failure to paint lines on the road and post signs indicating two way traffic causes head on collision. Elderly passenger sustains multiple fractures and the need for multiple surgeries - $800,000.00 settlement.

Surgical Error Leads to Need for Colostomy - $800,000

Failure to properly perform laporascopic cyst removal resulted in a perforation of the bowel and the need for a colostomy and a later colostomy reversal. The Medlaw team was able to achieve a settlement in the amount of $800,000.00.

Birth Injuries

Cerebral Palsy - $13 MILLION

In this matter the infant sustained a cerebral palsy injury during the childbirth process as a result of the obstetrician’s failure to perform a timely C-section and the baby being deprived of oxygen.

The total settlement amounted to over thirteen ($13,000,000) dollars. This included payment of immediate money as well as the purchase of a lifetime annuity that provided for increasing amounts of money to be paid to the infant over the course of her lifetime and 6 future lump-sum payments.

Erb's Palsy - $7 MILLION

Excessive pressure applied during childbirth caused Erb’s Palsy injury to infant resulting in nerve damage and shortening of the arm. The Med Law team achieved a settlement with a lifetime value of over seven million ($7,000,000) dollars. This settlement included payment of immediate monies and the purchase of a lifetime annuity for the infant which provided monthly payments increasing yearly over the infant’s life and 8 guaranteed future lump-sum payments.

Erb's Palsy - $4.9 MILLION

As a result of a failure to recognize the need for a C-section, the infant sustained an Erb’s Palsy injury to her arm. A settlement with a lifetime value of $4,910,337 was achieved which included a lifetime annuity with monthly payments beginning at age 18 and increasing annually for life, as well as 6 guaranteed future lump sum payments.

Failure to Perform timely C-Section Causes Infant Plaintiff to Sustain Cerebral Palsy - $4.75 MILLION Settlement with a value of $24 MILLION

Failure to timely perform a C-Section to deliver this infant results in oxygen loss and brain damage to the newborn. Bonina and Bonina, P.C. asserted that an emergency C-Section should have been performed given that there was both a face presentation and thick meconium present during labor, and that the fetal heart decelerations should have clearly indicated fetal distress. The 4.75 million dollar settlement included an annuity with lifetime payments which, in the event that the infant lived a normal life expectancy, would result in a total award of over $24,000,000.00 tax free to the infant.

Failure to timely perform C-Section causes infant to sustain Cerebral Palsy - $4.25 MILLION settlement with a value of $28 MILLION

Failure to recognize and address fetal distress and a dropping fetal heart rate caused this infant to sustain a Severe Hypoxic Ischemic Insult prenatally, resulting in cerebral palsy and a seizure disorder. The medlaw team obtained a $4.25 million dollar settlement that included a lifetime annuity that, in the event that the infant lives a normal life expectancy, would result in a total settlement package of over $28,000,000.00 tax free.

Failure to Perform Cerclage Causes Infant Plaintiff to Sustain Cerebral Palsy - $4.1 MILLION

Failure to perform a cerclage on a mother with a history of an incompetent cervix result in a severely premature delivery and the infant sustaining cerebral palsy with mental and physical disabilities. The $4,100,000.00 settlement included an annuity with lifetime payouts valued at over $12,000,000.00 tax free.

Delay in performing C-Section - Cerebral Palsy - $3.75 MILLION

Failure on the part of delivery staff to properly moniter labor and to recognize fetal distress resulted in meconium aspiration and in the infant plaintiff sustaining cerebral palsy. $3.75 million settlement

Improper Intubation - Brain Damage - $3.5 MILLION

A $3.5 Million Settlement was achieved on behalf of a 37 year old man who sustained brain damage as the result of improper intubation in an emergency room.

Inadequate Post Operative Monitoring - Brain Damage - $2.95 MILLION

Inadequate post operative monitoring of a child after cardiac surgery causes seizures, brain damage and cardiac arrest to infant plaintiff. Bonina and Bonina, P.C. argued that the respiratory and cardiac arrest resulted from defendant's failure to properly intubate the infant and to properly monitor his oxygenation following the improper intubation. As a result, the child suffered significant and permanent brain damage for which he continues to receive therapies today. $2.95 Million settlement, which includes an annuity and provided for tax benefits that increased the gross overall value of the settlement proceeds to approximately $9,000,000.00.

Erb's Palsy - $1.4 MILLION

In this matter the law firm of Bonina & Bonina was able to achieve a settlement on behalf of an infant whose arm was injured as a result of excessive force being used during the childbirth process, with a lifetime value of over $1.4 million.

Cerebral Palsy - $1 MILLION

A young man sustained a cerebral palsy injury as a result of errors by his mother’s obstetricians during her pre-natal care. As a result he had spasticity in his leg and developmental delays. A one million ($1,000,000) dollar settlement was achieved, even though the plaintiff had gone on to college and was achieving good grades.

Failure to recognize the need for Cesarean Section - Erb's Palsy - $1 MILLION

The physicians and hospital caring for a gestational diabetic failed to estimate fetal weight, failed to properly manage shoulder dystocia, and failed to perform a cesarian section despite knowing the mother had a history of giving birth to large babies and had been in labor for over 20 hours. The infant sustained a severe erb's palsy, including arm shortening, winging and an inability to use the hand on her affected arm. $1,000,000.00 Settlement

Failure to recognize the need for C-Section - Erb's Palsy- $975,000

The delivering physician failed to perform a C-section, which was indicated here due to cephalo-pelvic disproportion/ fetal pelvic disproportion, and arrest of labor. The infant sustained a severe erb's palsy which required nerve grafting surgery. $975,000.00 Settlement

Failure to Timely Perform a C-Section and Negligent Uterine Suturing - $950,000

Failure to timely perform a C-Section and negligent performance of B Lynch suturing results in uterine necrosis, abscess, and the necessity for a total abdominal hysterectomy to a young woman. $950,000.0 settlement

Failure to perform a C-Section - Erb's Palsy to infant - $625,000

Failure to recognize shoulder dystocia and failure to perform a C-section to deliver an infant weighing over 11 lbs results in Erb's Palsy necessitating ongoing physical therapy and surgery.

Failure to Diagnose Cancer

Stomach Cancer Wrongful Death - $3 MILLION

A settlement with a total value of $ 3,034,199.11 was achieved on behalf of the family of a man who died of stomach cancer. There was a lengthy delay in diagnosing stomach cancer in this middle-aged father of three. This settlement included a lifetime annuity for the decedent’s minor child.

Breast Cancer Wrongful Death - $1.8 MILLION

In this matter the law firm of Bonina & Bonina was able to achieve a $1.8 million dollar settlement on behalf of the surviving husband and two children of a woman who died as a result of a delay in diagnosing breast cancer. It was alleged a needle biopsy would have diagnosed the breast cancer and given an increased chance for survival.

Lung Cancer - $1.1 MILLION

In this matter the Med Law Team achieved a settlement of $1.1 million on behalf of a plaintiff who had a greatly shortened life expectancy as a result of a failure to diagnose lung cancer. In this matter the plaintiff had gone for pre-operative x-rays which revealed the presence of a suspicious mass in her lungs, however, her surgeon failed to follow-up on the findings thereby resulting in a one-year delay of the diagnosis of her cancer. This delay significantly shortened her life span by permitting the cancer to spread untreated for an extensive amount of time.

Colon Cancer Wrongful Death - $850,000

In this matter the surviving siblings of a middle-aged, single woman with no children sued for her wrongful death claiming that her doctors failed to diagnose colon cancer. A settlement of eight hundred and fifty thousand dollars ($850,000) was reached.

Failure to Diagnose Breast Cancer - $750,000

A $750,000 settlement was achieved for this married woman whose breast cancer spread to her lymph nodes, and needed radical mastectomy and chemotherapy as a result of a failure to timely diagnose breast cancer.
